Questions If you or a family member is injured on the job and your employer is a non subscriber to workers compensation insurance, questions must be asked. (1) Did your employer fail in its responsibility to provide a safe place for you and other employees to work? If so, it may be liable for money damages that you sustained resulting from your injuries. (2) Did a third party operating on your job destroy the safety of your work place by bringing in a defective piece of equipment or allowing unsafe workers to be in your work place, thus endangering all other workers. No Worker's Comp If you have been injured as a result of an accident on your job, your employer may not carry Texas Worker's Compensation Insurance. Your employer may be what is known as a "non subscriber" to worker's compensation insurance. Legal rights The fact that your employer is a non subscriber does not mean that you do not have legal rights that need to be protected. Your injuries will probably cause you to need medical care. Your employer may not be paying you while you are off work for your lost wages. Lost wages, medical bills, pain and suffering, and loss of ability to perform your job may well be money damages that you can recover from your employer if your employer is a non subscriber. |
