Taxotere lawsuits..

A large number of breast cancer patients in the U.S. have taken Sanofi's chemotherapy drug, Taxotere, to treat various forms of cancer. Many women who were left with permanent hair loss from the drug are filing lawsuits against Sanofi, the manufacturer of Taxotere. Hair loss is a known side effect of many cancer treatments, but it is only temporary in most treatments. Sanofi failed to warn patients taking Taxotere that their drug could cause permanent hair loss when they knew that this was a known side effect.

Despite informing patients who used their cancer drug in other countries, Sanofi did not warn women in the U.S. The words “permanent hair loss” or “alopecia”, the technical word for the condition of permanent hair loss, do not appear in any information published by Sanofi in the U.S. in regard to Taxotere according to lawsuits.
This failure to warn removed the choice of patients in their decision to use or not use Taxotere, to risk permanent hair loss by using this drug. That decision making process was denied to Taxotere patients in U.S. by the decision of Sanofi to not warn.

Texting while driving

TEXTING WHILE DRIVING IS OUTLAWED IN TEXAS

On Friday, May 19, 2017,the Texas Senate HB 62, which outlaws texting while driving. The new law does not effect talking on a cell phone while driving or texting on a map app for directions. 

“I have waited 10 years to make this motion,” said state Sen. Judith Zaffirini.
The state’s rules, if signed by the governor, would supersede city texting bans and allow for other uses such as mapping features. Cities, such as Austin and Bellaire, could still prohibit talking on a phone while driving, or require hands-free devices to talk on a phone while driving.

Under the state ban, drivers could still text when the vehicle is not in motion, and use their phone for texting in case of emergency.

The bill only requires the signature of the governor and it will become law sometime in the near future.

Taxotere

Taxotere® is a drug known as docetaxel. It is a chemotherapy drug used to treat breast cancer and has been linked to permanent hair loss, also known as permanent significant alopecia, or PSA.
 
Many people are filing lawsuits against the manufacturer of Taxotere, Sanofi-Aventis, because they failed to warn patients and the medical community about the risk of permanent baldness from taking Taxotere.
While temporary hair loss is a common side effect of breast cancer chemotherapy, permanent hair loss is not.
 
Sanofi had prior knowledge through their own in-house studies that there was a 10% chance that their drug would cause permanent hair loss, not just temporary hair loss. In spite of this knowledge they failed to timely warn the public in the United States that this permanent hair loss was a possibility even though they had previously warned in Canada and Europe through a labeling process.
 
The disfigurement of permanent hair loss is an unacceptable side effect when the patient has no idea that this is a possible outcome of taking the drug. The emotional damage of having cancer to begin with should not be compounded with the reality that your hair may never grow back. Unacceptable.

Missouri Talcum Powder Cancer Lawsuit Could Go to New Jersey MDL

Kansas City, MOA talcum powder cancer lawsuit filed in state court by multiple plaintiffs in Missouri has been removed to federal court by attorneys for Johnson & Johnson, who may transfer the case to a multidistrict litigation in New Jersey.

The federal court uses multidistrict litigation (MDL) to manage large numbers of similar cases by transferring them to a single judge for pre-trial discovery.

The lawsuit Anastasia Paniagua et al v. Johnson & Johnson et al, Case No. 4:17-cv-00232, US District Court, Western District of Missouri was originally filed Jan. 31, 2017 in Jackson County Missouri Circuit Court by 14 people from 12 states against Johnson & Johnson, Johnson & Johnson Consumer Companies and three other companies on behalf of themselves or their deceased relatives.

The plaintiffs claimed that Johnson & Johnson's Baby Powder and Shower-to-Shower products caused ovarian cancer. The lawsuit, which Johnson & Johnson removed from state court to Missouri Western District federal court on Mar. 31, was one of thousands of talcum powder lawsuits filed against Johnson & Johnson in state and federal courts nationwide.

Approximately 1,000 talcum powder cases were consolidated in Missouri's 22nd Circuit Court in St. Louis, Missouri. Similar complaints are pending in New Jersey, Delaware and California, and more federal talcum powder lawsuits were consolidated in a multidistrict litigation in New Jersey, MDL 2738.

In Oct. 2016, the Judicial Panel on Multidistrict Litigation issued an order establishing MDL No. 2738 regarding Johnson & Johnson talcum powder products marketing and sales practices to go before US District Judge Freda L. Wolfson, US District Court for the District of New Jersey.

In a motion for removal of the Jackson County lawsuit to federal court, attorneys for Johnson & Johnson gave notice of their intention to attempt to seek transfer of the case to the New Jersey MDL.

In the past year, St. Louis juries awarded $70 million to plaintiffs in one lawsuit trial against Johnson & Johnson, $72 million in another proceeding and $55 million in an earlier trial.
